Give the Gift of Cannabis

Sharing is Legal Now!

Do you have one of those incredibly hard to shop for people in your life? You know, the person who seems to have everything? Well, you can now legally give them a gift of cannabis in Washington state -- a gift that is sure to surprise and delight!

But before you start making a goodie bag or a plate of medicated cookies for a loved one, you need to know that there are strict rules about how you can gift cannabis and they have recently changed.

In the spring of 2017, Governor Inslee signed SB 5131, which, among other things, legalizes the sharing of cannabis. Before that time, it was technically illegal to pass a joint to a friend.

With the passage of this bill, Washingtonians over the age of 21 may now share the following with another adult who is also 21+:

  • Up to one ounce (approximately 28 grams) of cannabis flowers (bud)
  • 16 ounces of marijuana-infused edibles in solid form
  • 72 ounces in liquid form
  • 7 grams of marijuana concentrates purchased in a retail store

Attorney Nicole Li, who is one of our professors in our Medical Marijuana Consultant Certificate Program and leads our Law and Ethics for Medical Marijuana Consultants course, offers the following clarification of this law for those who grow their own cannabis at home:

"Can home growers give their weed away for free to anyone? No. The state wants all marijuana legally consumed in WA to have been through the legal system in WA. Definitely no sales from home grows -- and donation of homegrown product only to those folks already associated with the home grow."

While changes may come too slow for some cannabis enthusiasts, this is progress -- since even sharing a joint was technically a felony prior to this bill's passage.

And these rules only protect you giving gifts within Washington state; transporting cannabis across state lines, regardless of purpose, remains a violation of the law.

Another element to keep in mind is that you should err on the side of caution when wrapping and presenting the gift. Keep cannabis out of reach of children and remember that any edibles could be found and devoured by a curious pet.

So don't hesitate to share in the season with someone you love by giving them quality, tested cannabis from Washington State.
